SIGAUS Announcement regarding the halt of non-essential activities

Following the entry into force yesterday, 29 March 2020, of Royal Decree-Law 10/2020 declaring the halt of non-essential activities in order to reduce the movement of people in the context of the fight against COVID-19, and in relation to the activities of the integrated management system (IMS) for used oils, SIGAUS, after consulting its legal advisers, communicates the following:

32. Actividades no esenciales.

SIGAUS is maintaining their activity as they operate in one of the sectors classified as essential in section 18 of the Annexe of this Royal Decree-law.

The IMS for used oils is maintaining their activity because they operate in one of the sectors classified as essential in section 18 of the Annexe of this Royal Decree-law, which directly quotes “services with regard to collection, management and treatment of hazardous waste, as well as urban solid waste, hazardous and non-hazardous, wastewater collection and treatment, decontamination activities and other waste management services…”.

It does not indicate waste management services but with regard to; therefore, it includes IMS, and the workers of their management entities, even if those entities do not directly provide waste management services. And this, regardless of whether they can carry out all their activity remotely.

• Likewise, companies that carry out different management operations for used oils are also included.

Member companies. They can continue to develop their activity, according to section 5 of the Annexe “those essential for the maintenance of production activities of the manufacturing industry that offer the supplies, equipment, and materials necessary for the correct development of essential activities”. Therefore, manufacturing (EU imports and acquisition), distribution and marketing activities for industrial oils may remain active, as they are essential materials for the operation of the factories in which essential activities are carried out, and for vehicles transporting people or goods which, in itself, is an essential activity contemplated in the Royal Decree-Law (in the cases in section 6 of the Annexe).
