Agreement on new waste directives
The Committee for the Environment, Public Health and Food Safety of the European Parliament approved a provisional agreement in February on the legislative proposals for a set of measures for waste in the Circular Economy package, including the new “framework” directive for waste in the EU. In the coming months, formal approvals are expected from the European Parliament and the Council. With regards to used oils, the new directive with establish a flow of information from the Member states to the European Commission, and a report from the latter, before the end of 2022, accompanied by a proposal of measures to improve the treatment of this waste, which may include quantitative regeneration objectives.

The agreement reached with the European Parliament, together with the procedure by the Permanent Representatives Committee by the EU Council is an almost definitive step forwards for the approval of modifications in the directives on waste, packaging and waste from packaging, electrical and electronic devices, batteries and accumulators, dumps and vehicles at the end of their useful life, with definitive approval being expected before the summer.
The new “framework” waste directive will not include important modifications to the regime applicable to used industrial oils, although it must be highlighted that there is express recognition of regeneration as the priority management method for this waste.

The main novelty is the requirement of information for the member states, who will be requested to provide data regarding the placement of industrial oil on the market and the used oil collected and treated since 2020. The European Commission will prepare a report, before the end of 2022, which may include proposals for legislative measures for the Parliament and Council, including possible obligatory regeneration targets for the entire EU.

The main novelty, however, lies in the requirement of information for the member states, from whom, through a questionnaire that must be defined before March 31st 2019, data will be requested regarding the placement of industrial oil on the market and the used oil collected and treated in 2020 and thereafter. With said data, the European Commission will create a report, before the end of 2022, which may include proposals on legislative measures for the Parliament and Council. Among them, obligatory regeneration targets may be established for the entire EU.
Also, the new Directive anticipates that before 2025, the new members will establish the obligation for separate collection of hazardous waste from homes which will affect packaging of lubricant oils under 5 litres, currently assimilated in the flow of domestic waste. On the other hand, the member states are authorised to adopt measures to promote the principle of hierarchy, including incentives, tax or otherwise, for the use of products originating from recycled waste (such as , for example, oil made with regenerated bases).
Finally, as a consequence of the modification of the packaging directive, also before 2025, extended responsibility of the producer systems must be implemented for all packaging, including commercial and industrial packaging which is currently the responsibility of those who posses them.
